Terms of Use

The rules for using this website and the Nova portal, and a clear statement of what this site is not.

Last updated

01Using this site means accepting these terms

These terms govern novabuilding.co and the Nova Building Co portal. If you use the site, you accept them. If you do not, stop using the site.

Our specialist sites, Nova Roofing & Siding and Nova Kitchens & Designs, are separate properties with their own terms. These do not apply there.

02The site is informational. Nothing on it is a quote

Everything here, service pages, project descriptions, material notes, process explanations, is published to help you understand how we work. It is general information about construction, not an offer, not a bid, and not a contract.

  • No page on this site constitutes a binding quote, price, or commitment to perform work.
  • Submitting a form does not create a contract, reserve a spot on our schedule, or obligate us to take the job.
  • Descriptions of methods, materials and warranties are general. What actually governs your project is the signed written contract and its scope of work.
  • Where anything on this site conflicts with your signed contract, the contract wins.

We keep this site accurate, but building codes change, products get discontinued and manufacturer warranties get revised. We do not guarantee that every page is current at the moment you read it.

03Estimates require a site visit

We do not price construction work from a web form. A real number requires seeing the property: the existing framing, the roof pitch and layers, the condition of the sheathing, the subfloor, access for equipment, and what the town wants for permits.

  • Any figure discussed before a site visit is a conversation, not an estimate.
  • A written estimate is valid for the period stated on the estimate itself. Material pricing moves, and an old number is not a number we can hold.
  • Estimates are based on visible conditions. Rot, failed flashing, undersized framing, knob-and-tube wiring and other conditions hidden behind finishes are addressed by written change order once found.
  • Work begins after a signed contract, not after an email agreeing to a number.

04Portal accounts (not yet issued) are for authorized users only

The Nova portal is not open. No accounts have been issued, and the sign-in form on the portal page is switched off, it does not submit anywhere. Anyone asking you for a Nova portal password today is not us.

These are the rules that will apply to the portal once it opens, set out now so they are on the record before anyone gets an account. It will be a private system for clients, subcontractors and Nova staff, accounts will be issued by us, and there will be no public sign-up.

  • You may use only an account issued to you, and only for the project or projects it is attached to.
  • Do not share your credentials, and do not let anyone else use your account. You are responsible for what happens under it.
  • Tell us immediately if you think your account has been accessed by someone else.
  • Job data in the portal, drawings, addresses, pricing, schedules, client contact details, is confidential. Subcontractors and vendors may use it to perform their work on that job and for nothing else.
  • We may suspend or close any account at any time, including when a project closes out or a working relationship ends.
  • Do not attempt to reach data belonging to another account, another project, or another trade.

05Acceptable use

When you use this site, you agree not to:

  • Break any federal, New Hampshire, Maine or local law while using it.
  • Submit false information through a form, impersonate someone else, or send inquiries on behalf of a person who did not ask you to.
  • Scrape, harvest or copy content in bulk, including for training a model or rebuilding our service pages elsewhere.
  • Probe, scan or test the security of the site or the portal, or try to get around any authentication or rate limit.
  • Upload anything malicious, or anything you do not have the right to share.
  • Use our contact form or phone number to sell us something you were not invited to sell us.

06Our content, and photos of your project

The text, layout, design, logos and any photographs published on this site belong to Nova Building Co or are used with permission. You can link to any page here, and you can quote a reasonable excerpt with attribution. You cannot republish our pages, copy our service descriptions onto another contractor's site, or use our name or mark in a way that suggests we endorse you.

Where this site publishes a photograph of work performed on a client's property, these rules apply to it:

  • We own the photograph. The client owns the house. Publishing the photo does not give anyone rights to the property, and it does not transfer the photo rights to a third party.
  • We do not publish street addresses or identifying documents alongside project photos.
  • Clients can ask that their project stay out of public marketing. Tell us and we will mark it internal-only.
  • If a manufacturer, supplier or design partner ever wants to feature a job, we will ask you before we submit it.

If you believe something on this site infringes your copyright, send the details to Nic@novabuilding.co and we will look at it promptly.

07Links to other sites

We link to manufacturers, code resources, town building departments and our own specialist sites. We do not control third-party sites and are not responsible for their content, their products or their privacy practices. A link is a pointer, not an endorsement of everything on the other end of it.

08The site is provided as is

We make no warranty that this website will be uninterrupted, error-free, or free of anything harmful, and no warranty that the information on it is complete or current. The site is provided as is and as available, and to the extent the law allows, we disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement as they apply to the website.

Read that narrowly: it is about the website. It is not a disclaimer of any warranty covering work we perform. Warranty terms are set out in your signed contract, and nothing on this page changes what that document says.

09Limitation of liability

To the fullest extent permitted by law, Nova Building Co is not liable for indirect, incidental, special or consequential damages arising out of your use of this website or the portal, including lost data, lost profits, or decisions made in reliance on general information published here rather than on a written estimate and contract.

Nothing in this section limits liability that cannot be limited by law, and nothing in it limits our obligations under a signed construction contract. Claims relating to work we performed are governed by that contract and by New Hampshire and Maine law, not by this page.

Construction is inherently a field where conditions are discovered as work proceeds. Information published here about typical assemblies, methods and timelines describes how we normally work. It is not a promise about your specific house.

10Governing law

These terms are governed by the laws of the State of New Hampshire, without regard to conflict of law rules. Disputes about this website or these terms belong in the state or federal courts located in New Hampshire. Work performed in Maine may be subject to Maine law under the applicable contract.

11Changes to these terms

We can update these terms. When we do, the date at the top of the page changes, and the updated version applies to use of the site from that point forward. Continuing to use the site after a change means you accept the current version.

12Contact

Questions about these terms go to Nic@novabuilding.co.
